Le seguenti Condizioni Generali di Vendita regolano l’offerta e la vendita di prodotti su questo sito web www.buellservice.com<\/a>.<\/p>\r\n\r\n\r\n\r\n

I prodotti acquistati sul Sito sono offerti e venduti Buell Service di Luca Mammarella con sede in Via Castorani 2 65020 Alanno Iscritta al registro delle imprese di Chieti con Partita iva 02249000684<\/p>\r\n\r\n\r\n\r\n

1. Ambito di applicazione<\/p>\r\n\r\n\r\n\r\n

1.1 La vendita di prodotti tramite il Sito (Prodotti) costituisce un contratto a distanza disciplinato dal Capo I, Titolo III (artt. 45 e ss.) del Decreto Legislativo 6 settembre 2005, n. 206 (Codice del Consumo) e dal Decreto Legislativo 9 aprile 2003, n. 70, contenente la disciplina del commercio elettronico.<\/p>\r\n\r\n\r\n\r\n

1.2 Le Condizioni Generali di Vendita possono essere modificate in ogni momento. Eventuali modifiche e\/o nuove condizioni saranno in vigore dal momento della loro pubblicazione sul Sito. Per questo motivo gli utenti sono invitati ad accedere con regolarit\u00e0 al Sito e a consultare, prima di effettuare qualsiasi acquisto, la versione pi\u00f9 aggiornata delle Condizioni Generali di Vendita. Le Condizioni Generali di Vendita applicabili sono quelle in vigore alla data di invio dell’ordine di acquisto.<\/p>\r\n\r\n\r\n\r\n

1.3 Le presenti Condizioni Generali di Vendita non disciplinano la vendita di prodotti e\/o la fornitura di servizi da parte di soggetti diversi da Buell Service che siano presenti sul Sito tramite link, banner o altri collegamenti ipertestuali. Prima di effettuare transazioni commerciali con tali soggetti \u00e8 necessario verificare le loro condizioni di vendita. Buell Service non \u00e8 responsabile per la fornitura di servizi e\/o per la vendita di prodotti da parte di tali soggetti. Sui siti web consultabili tramite tali collegamenti Buell Service non effettua alcun controllo e\/o monitoraggio. Buell Service non \u00e8 pertanto responsabile per i contenuti di tali siti n\u00e9 per eventuali errori e\/o omissioni e\/o violazioni di legge da parte degli stessi.<\/p>\r\n\r\n\r\n\r\n

2. Acquisti sul Sito<\/p>\r\n\r\n\r\n\r\n

2.1 L’accesso alle vendite effettuate tramite il Sito \u00e8 riservato esclusivamente a utenti che abbiano compiuto gli anni 18.<\/p>\r\n\r\n\r\n\r\n

2.2 Buell Service\u00a0 si riserva il diritto di rifiutare o cancellare ordini che provengano (i) da un utente con cui essa abbia in corso un contenzioso legale; (ii) da un utente che abbia in precedenza violato le presenti Condizioni Generali di Vendita e\/o le condizioni e\/o i termini di un contratto di acquisto con Buell Service; (iii) da un utente che sia stato coinvolto in frodi di qualsiasi tipo e, in particolare, in frodi relative a pagamenti con carta di credito; (iv) da utenti che abbiano rilasciato dati identificativi falsi, incompleti o comunque inesatti ovvero che non abbiano inviato tempestivamente a Buell Service i documenti dalla stessa richiesti in base alle presenti Condizioni Generali di Vendita o che le abbiano inviato documenti non validi; (v) da utenti che non diano sufficienti garanzie di solvibilit\u00e0.<\/p>\r\n\r\n\r\n\r\n

3. Registrazione al Sito<\/p>\r\n\r\n\r\n\r\n

3.1 L\u2019acquisto di Prodotti sul Sito \u00e8 permesso sia ad utenti registrati, sia ad utenti che non siano registrati al Sito. La registrazione al Sito \u00e8 gratuita.<\/p>\r\n\r\n\r\n\r\n

3.2 Le credenziali di registrazione devono essere utilizzate esclusivamente dall’utente e non possono essere cedute a terzi. L’utente si impegna a tenerle segrete e ad assicurarsi che nessuno vi abbia accesso, nonch\u00e9 ad informare senza indugio Buell Service, contattandola come indicato all\u2019art. 14, in caso di sospetto uso indebito e\/o divulgazione delle stesse. L’utente garantisce che le informazioni personali fornite durante la procedura di registrazione al Sito sono complete e veritiere. L’utente accetta di tenere Buell Service indenne da qualsiasi danno, obbligo risarcitorio e\/o sanzione derivante da e\/o in qualsiasi modo collegati alla violazione da parte dell’utente delle regole sulla registrazione al Sito o sulla conservazione delle credenziali di registrazione.<\/p>\r\n\r\n\r\n\r\n

4. Informazioni dirette alla conclusione del contratto<\/p>\r\n\r\n\r\n\r\n

4.1 In conformit\u00e0 al Decreto Legislativo 9 aprile 2003, n. 70 recante disposizioni in materia di commercio elettronico, Buell Service informa l’utente che:<\/p>\r\n\r\n\r\n\r\n

-per concludere il contratto di acquisto di uno o pi\u00f9 Prodotti sul Sito, l’utente dovr\u00e0 compilare un modulo d’ordine in formato elettronico e trasmetterlo a Buell Service, in via telematica, seguendo le istruzioni che compariranno di volta in volta sul Sito e che accompagneranno le diverse fasi dell’acquisto;<\/p>\r\n\r\n\r\n\r\n

-il contratto \u00e8 concluso quando il modulo d’ordine perviene al server di Buell Service;<\/p>\r\n\r\n\r\n\r\n

-una volta registrato il modulo d’ordine e ricevuta la conferma della autorizzazione al pagamento dell’importo totale dovuto, Buell\u00a0 Service invier\u00e0 all’utente, via e-mail all’indirizzo di posta elettronica indicato, la conferma dell’ordine, contenente le informazioni relative alle caratteristiche del Prodotto acquistato, l’indicazione dettagliata del prezzo, del mezzo di pagamento utilizzato, delle informazioni sul diritto di recesso, delle spese di consegna e di eventuali costi aggiuntivi nonch\u00e9 dei contatti del Servizio Clienti, cui l’utente pu\u00f2 rivolgersi per richiedere assistenza e\/o presentare reclami. Si raccomanda di conservare la e-mail ricevuta come prova d’acquisto. Le Condizioni Generali di Vendita applicabili all\u2019ordine, nonch\u00e9 le istruzioni tipo sul recesso e il modulo tipo di recesso di cui all\u2019art. 10 saranno allegati alla e-mail di conferma della spedizione del prodotto acquistato.<\/p>\r\n\r\n\r\n\r\n

-il modulo d’ordine sar\u00e0 archiviato nella banca dati di Buell Service per il tempo necessario all’evasione\u00a0 dell’ordine e, comunque, nei termini di legge. Per accedere al proprio modulo d’ordine l’utente potr\u00e0 consultare il proprio account.<\/p>\r\n\r\n\r\n\r\n

5. Validit\u00e0 delle offerte e prezzi<\/p>\r\n\r\n\r\n\r\n

5.1 Tutti i prezzi dei Prodotti sono espressi in Euro (\u20ac) e si intendono inclusi della Imposta sul Valore Aggiunto (“IVA”). Ogni eventuale costo aggiuntivo, IVA compresa, sar\u00e0 espressamente e separatamente indicato nel modulo d’ordine, prima che l’utente proceda alla trasmissione del medesimo.<\/p>\r\n\r\n\r\n\r\n

5.2 Il prezzo dei Prodotti pu\u00f2 essere modificato da Buell Service in ogni momento, senza preavviso, fermo restando che il prezzo addebitato all’utente sar\u00e0 quello pubblicato sulla scheda informativa che illustra le principali caratteristiche del Prodotto (Scheda Prodotto) al momento dell’invio dell’ordine. Non si terr\u00e0 conto di eventuali variazioni (in aumento o in diminuzione) di prezzo successive alla trasmissione dell\u2019ordine.<\/p>\r\n\r\n\r\n\r\n

5.3 Sul Sito possono essere offerti in vendita Prodotti a prezzi scontati. Il prezzo pieno indicato sul Sito (Prezzo Barrato) e rispetto al quale \u00e8 calcolato lo sconto che Buell Service\u00a0 applica corrisponde al prezzo di listino pubblicato sul Sito.<\/p>\r\n\r\n\r\n\r\n

6. Ordini di acquisto – Informazioni sui Prodotti<\/p>\r\n\r\n\r\n\r\n

6.1 Buell Service dar\u00e0 corso all’ordine di acquisto, e quindi effettuer\u00e0 la spedizione del Prodotto acquistato, solo dopo aver ricevuto conferma dell’autorizzazione al pagamento dell’importo totale dovuto, costituito dal prezzo d’acquisto, dalle spese di consegna, se applicate, e da ogni altro eventuale costo aggiuntivo, come indicato nel modulo d’ordine (Importo Totale Dovuto). Nel caso in cui l\u2019Importo Totale Dovuto non venga pagato ovvero il buon esito del pagamento non sia confermato, il contratto di acquisto si intender\u00e0 pertanto risolto di diritto ai sensi e per gli effetti di cui all’art. 1456 c.c.. Di tale risoluzione e della conseguente cancellazione dell\u2019ordine, l\u2019utente sar\u00e0 avvisato immediatamente dopo la trasmissione dell\u2019ordine, tramite il Sito.<\/p>\r\n\r\n\r\n\r\n

6.2 I Prodotti resteranno di propriet\u00e0 di Buell Service fino all’avvenuto pagamento da parte dell’utente dell’Importo Totale Dovuto. Il rischio di perdita o danneggiamento dei Prodotti, per causa non imputabile a Buell Service , invece, sar\u00e0 trasferito all\u2019utente quando l\u2019utente, o un terzo dallo stesso designato e diverso dal vettore, entrer\u00e0 materialmente in possesso dei Prodotti.<\/p>\r\n\r\n\r\n\r\n

6.3 Ciascun Prodotto \u00e8 accompagnato da una Scheda Prodotto. Le immagini e le descrizioni presenti sul Sito riproducono quanto pi\u00f9 fedelmente possibile le caratteristiche dei Prodotti. I colori dei Prodotti, tuttavia, potrebbero differire da quelli reali per effetto delle impostazioni dei sistemi informatici o dei computer utilizzati dagli utenti per la loro visualizzazione. Le immagini del Prodotto presenti nella Scheda Prodotto, inoltre, potrebbero differire per dimensioni o in relazione a eventuali prodotti accessori. Tali immagini devono pertanto essere intese come indicative e con le tolleranze d\u2019uso. Ai fini del contratto di acquisto, far\u00e0 fede la descrizione del Prodotto contenuta nel modulo d\u2019ordine trasmesso dall\u2019utente.<\/p>\r\n\r\n\r\n\r\n

7. Disponibilit\u00e0 dei Prodotti<\/p>\r\n\r\n\r\n\r\n

7.1 I prodotti offerti sul Sito sono in numero limitato. Pu\u00f2 quindi accadere, anche a causa della possibilit\u00e0 che pi\u00f9 utenti acquistino contemporaneamente lo stesso Prodotto, che il Prodotto ordinato non sia pi\u00f9 disponibile successivamente alla trasmissione dell’ordine di acquisto.<\/p>\r\n\r\n\r\n\r\n

7.2 In ogni caso di indisponibilit\u00e0 del Prodotto ordinato, fatti salvi i diritti attribuiti all\u2019utente dalla legge, e, in particolare, dal Capo XIV del Titolo II del Libro IV del codice civile, l\u2019utente sar\u00e0 prontamente informato per e-mail. L\u2019utente sar\u00e0, quindi, legittimato a risolvere immediatamente il contratto, salvo il diritto al risarcimento del danno, ai sensi e per gli effetti di quanto previsto dall\u2019art. 61, IV e V comma, del Codice del Consumo. Nel caso in cui l\u2019utente si avvalga del diritto di risoluzioneexart. 61, IV e V comma, Codice del Consumo ovvero in ogni caso in cui il pagamento dell\u2019Importo Totale Dovuto sia gi\u00e0 avvenuto, Buell Service , fatto salvo il diritto dell\u2019utente al risarcimento del danno, effettuer\u00e0 il rimborso di tale importo senza indebito ritardo e, in ogni caso, entro il termine massimo di 15 giorni lavorativi dall\u2019invio dell\u2019ordine. L\u2019importo del rimborso sar\u00e0 comunicato all\u2019utente via e-mail. Tale importo sar\u00e0 accreditato sullo stesso mezzo di pagamento utilizzato dall\u2019utente per l\u2019acquisto. Eventuali ritardi nell\u2019accredito possono dipendere dall\u2019istituto bancario, dal tipo di carta di credito o dalla soluzione di pagamento utilizzata. In ogni caso, la data di valuta sar\u00e0 la stessa dell\u2019addebito.<\/p>\r\n\r\n\r\n\r\n

7.3 Nel caso di ordini aventi ad oggetto una pluralit\u00e0 di Prodotti (Ordine Multiplo), qualora la sopravvenuta indisponibilit\u00e0 riguardi solo taluni dei Prodotti oggetto dell\u2019Ordine Multiplo \u2013 fatti salvi i diritti attribuiti all\u2019utente dalla legge, e, in particolare, dal Capo XIV del Titolo II del Libro IV del codice civile, e fatta salva l\u2019applicazione dell\u2019art. 7.2 che prece, qualora la sopravvenuta indisponibilit\u00e0 riguardi tutti i Prodotti oggetto dell\u2019ordine \u2013 Buell Service\u00a0 avviser\u00e0 immediatamente l\u2019utente tramite e-mail. L\u2019utente sar\u00e0, quindi, legittimato a risolvere immediatamente il contratto, limitatamente al\/ai Prodotto\/i divenuto\/i non disponibile\/i, salvo il diritto al risarcimento del danno, ai sensi e per gli effetti di quanto previsto dall\u2019art. 61, IV e V comma, del Codice del Consumo. Nel caso in cui l\u2019utente si avvalga del diritto di risoluzione di cui all\u2019art. 61, IV e V comma, Codice del Consumo, in relazione al\/ai Prodotto\/i divenuto\/i non disponibile\/i ovvero in ogni caso in cui il pagamento dell\u2019Importo Totale Dovuto sia gi\u00e0 avvenuto, Buell Service , fatto salvo il diritto dell\u2019utente al risarcimento del danno, effettuer\u00e0 il rimborso dell\u2019importo dovuto in relazione a tale\/i Prodotto\/i, comprese le spese di consegna, calcolate come indicato all\u2019art. 8.3 che segue, e ogni altro eventuale costo aggiuntivo dovuto in relazione specifica a tali Prodotti (Importo Parziale Dovuto) senza indebito ritardo e, in ogni caso, entro il termine massimo di 15 giorni lavorativi dall\u2019invio dell\u2019ordine. L\u2019importo del rimborso sar\u00e0 comunicato all\u2019utente via e-mail. Tale importo sar\u00e0 accreditato sullo stesso mezzo di pagamento utilizzato dall\u2019utente per l\u2019acquisto. Eventuali ritardi nell\u2019accredito possono dipendere dall\u2019istituto bancario, dal tipo di carta di credito o dalla soluzione di pagamento utilizzata. In ogni caso, la data di valuta sar\u00e0 la stessa dell\u2019addebito. La risoluzione dell\u2019intero Ordine Multiplo sar\u00e0 possibile solo nel caso di evidente e comprovata accessoriet\u00e0 dei Prodotti oggetto dell\u2019Ordine Multiplo divenuti indisponibili rispetto agli altri Prodotti oggetto dell\u2019Ordine Multiplo disponibili.<\/p>\r\n\r\n\r\n\r\n

8. Consegna dei Prodotti acquistati<\/p>\r\n\r\n\r\n\r\n

8.1 Qualora dovuto, l\u2019importo delle spese di consegna dovuto dall\u2019utente in relazione a uno specifico ordine, \u00e8 espressamente e separatamente indicato (in Euro e comprensivo di IVA) durante il procedimento di acquisto, nel riepilogo dell\u2019ordine e, in ogni caso, prima che l\u2019utente proceda alla trasmissione dello stesso. In caso di spedizioni verso zone al di fuori dell’UE ,superiori a kg 2 e con volume pari e\/o superiore a 1,5 mc, sar\u00e0 applicato un supplemento al costo della spedizione gi\u00e0 indicato nel riepilogo d’acquisto. Sar\u00e0 nostra premura contattare l’acquirente per comunicare tale importo.<\/strong><\/p>\r\n\r\n\r\n\r\n

8.2 Nel caso di omessa indicazione di un termine specifico di consegna, essa avverr\u00e0, in ogni caso, entro trenta giorni a decorrere dalla data di conclusione del contratto.<\/p>\r\n\r\n\r\n\r\n

8.3 Nel caso di recesso parziale da Ordini Multipli, l\u2019importo delle spese di consegna da rimborsare all\u2019utente sar\u00e0 quantificato in modo proporzionale al valore del Prodotto oggetto di recesso.<\/p>\r\n\r\n\r\n\r\n

8.4 L\u2019obbligazione di consegna \u00e8 adempiuta mediante il trasferimento della disponibilit\u00e0 materiale o comunque del controllo dei Prodotti all\u2019utente.<\/p>\r\n\r\n\r\n\r\n

Spetta all\u2019utente verificare le condizioni del Prodotto che gli \u00e8 stato consegnato\/che egli ha ritirato. Fermo restando che il rischio di perdita o danneggiamento dei Prodotti, per causa non imputabile a Buell Service \u00e8 trasferito all\u2019utente quando l\u2019utente, o un terzo dallo stesso designato e diverso dal vettore, entra materialmente in possesso del Prodotto, si raccomanda all\u2019utente di verificare il numero di Prodotti ricevuti e che l’imballo risulti integro, non danneggiato, n\u00e9 bagnato o comunque alterato, anche nei materiali di chiusura e lo si invita, nel suo interesse, a indicare sul documento di trasporto del vettore, eventuali anomalie, accettando il pacco con riserva. Il ricevimento senza riserve dei Prodotti, infatti, non consente all\u2019utente di agire in giudizio nei confronti del corriere, nel caso di perdita o danneggiamento dei Prodotti, tranne nel caso in cui la perdita o il danneggiamento siano dovuti a dolo o colpa grave del corriere stesso e fatta eccezione per la perdita parziale o il danneggiamento non riconoscibili al momento della consegna, purch\u00e9 in quest\u2019ultimo caso, il danno sia denunciato appena conosciuto e non oltre otto giorni dopo il ricevimento. Nel caso in cui la confezione presenti evidenti segni di manomissione o alterazione, si raccomanda inoltre all\u2019utente di darne pronta comunicazione al Servizio Clienti. Resta ferma, in ogni caso, la applicazione delle norme in materia di diritto di recesso e di garanzia legale di conformit\u00e0. Il corriere effettua due tentativi di consegna, dopodich\u00e9 rimander\u00e0 i Prodotti a Buell Service , la quale rimborser\u00e0 il denaro al cliente. Al momento della consegna nulla \u00e8 dovuto al corriere.<\/p>\r\n\r\n\r\n\r\n

8.5 Si applica quanto previsto dall\u2019art. 61 del Codice del Consumo nel caso in cui il Prodotto acquistato non sia consegnato o sia consegnato in ritardo rispetto ai termini di consegna indicati durante il procedimento di acquisto e nella conferma d\u2019ordine.<\/p>\r\n\r\n\r\n\r\n

In ogni caso, Buell Service\u00a0 si impegna a dare comunicazione all\u2019utente, tempestivamente e per e-mail, del ritardo nella consegna (E-mail di Avviso Ritardo), indicando contestualmente il nuovo termine di consegna, se disponibile (NuovoTermine di Consegna), fatti salvi i diritti dell\u2019utente ex art. 61 del Codice del Consumo e la possibilit\u00e0 di avvalersi in ogni momento degli ordinari mezzi di tutela messi a disposizione dalla legge e, in particolare, dal Capo XIV del Titolo II del Libro IV del codice civile.<\/p>\r\n\r\n\r\n\r\n

9. Modalit\u00e0 di Pagamento<\/p>\r\n\r\n\r\n\r\n

9.1 Il pagamento dei Prodotti pu\u00f2 essere effettuato mediante carta di credito o mediante la soluzione di pagamento PayPal. Nel caso in cui uno di tali mezzi\/soluzioni di pagamento non possa essere utilizzato in relazione a uno specifico Prodotto, ci\u00f2 sar\u00e0 chiaramente indicato sul Sito, al pi\u00f9 tardi all\u2019inizio della procedura di acquisto.<\/p>\r\n\r\n\r\n\r\n

9.2 Per la emissione della fattura faranno fede le informazioni all\u2019uopo fornite dall\u2019utente, che egli dichiara e garantisce essere rispondenti al vero, obbligandosi a tenere Buell Service\u00a0 indenne e manlevata da qualunque danno, comprese sanzioni emesse dalle autorit\u00e0 competenti, possa alla stessa derivare nel caso di mancata rispondenza al vero delle stesse. In caso di necessit\u00e0 di fatturazione, si prega di specificarlo all’interno della sezione “note dell’ordine”, in fondo all’inserimento dati.<\/p>\r\n\r\n\r\n\r\n

9.3 Pagamento mediante carta di credito o di debito<\/p>\r\n\r\n\r\n\r\n

9.3.1 Il pagamento dei Prodotti pu\u00f2 essere effettuato mediante carta di credito o di debito direttamente tramite il Sito.<\/p>\r\n\r\n\r\n\r\n

9.3.2 Al fine di garantire la sicurezza dei pagamenti effettuati sul Sito e prevenire eventuali frodi, Buell Service\u00a0 si riserva il diritto di chiedere all\u2019utente, tramite e-mail, di inviare, tramite lo stesso mezzo, una copia fronte\/retro della propria carta d’identit\u00e0 e, nel caso in cui l\u2019intestatario dell\u2019ordine sia diverso dall\u2019intestatario della carta, della carta d\u2019identit\u00e0 di quest\u2019ultimo. Il documento dovr\u00e0 essere in corso di validit\u00e0. Nella e-mail di richiesta sar\u00e0 specificato il termine entro il quale il documento deve pervenire a Buell Service . Tale termine non sar\u00e0, in ogni caso, superiore a 5 giorni lavorativi a decorrere dal ricevimento della richiesta da parte dell\u2019utente. In attesa del documento richiesto, l\u2019ordine sar\u00e0 sospeso. L\u2019utente \u00e8 tenuto all\u2019invio dei documenti richiesti nel termine indicato.<\/p>\r\n\r\n\r\n\r\n

9.3.3 Nel caso in cui Buell Service non riceva tali documenti nel termine specificato nella e-mail di richiesta ovvero riceva documenti scaduti o non validi, il contratto si intender\u00e0 risolto di diritto ai sensi e per gli effetti di cui all\u2019art. 1456 c.c. e l\u2019ordine conseguentemente cancellato, salvo il diritto di Buell Service\u00a0 al risarcimento di qualunque danno in cui la stessa possa essere incorsa a causa del comportamento non conforme dell\u2019utente. La risoluzione del contratto, di cui l\u2019utente sar\u00e0 avvisato tramite e-mail, entro e non oltre 5 giorni lavorativi dalla scadenza del termine per l\u2019invio dei documenti richiesti da Buell Service , comporter\u00e0 la cancellazione dell\u2019ordine, con conseguente rimborso dell\u2019Importo Totale Dovuto.<\/p>\r\n\r\n\r\n\r\n

9.3.4 Nel caso di ricevimento da parte di Buell Service\u00a0 di documentazione valida nel termine indicato nella e-mail di cui all\u2019art. 9.3.2 che precede, i termini di consegna decorreranno dalla data del ricevimento della stessa.<\/p>\r\n\r\n\r\n\r\n

9.3.5 I dati riservati della carta di credito (numero della carta, intestatario, data di scadenza, codice di sicurezza) sono criptati e trasmessi direttamente al gestore dei pagamenti senza transitare dai server di cui Buell Service si serve. Buell Service quindi non ha mai accesso e non memorizza i dati della carta di credito utilizzata dall\u2019utente per il pagamento dei Prodotti, fatto salvo, limitatamente al dato relativo all\u2019intestatario della carta, il caso previsto dagli artt. 9.3.2 e 9.3.3.<\/p>\r\n\r\n\r\n\r\n

9.4 Pagamento mediante soluzione di pagamento PayPal<\/p>\r\n\r\n\r\n\r\n

9.4.1 Il pagamento dei Prodotti acquistati sul Sito pu\u00f2 essere effettuato mediante la soluzione di pagamento PayPal. Qualora l\u2019utente scelga come mezzo di pagamento PayPal, egli sar\u00e0 reindirizzato sul sito www.paypal.it<\/a> dove eseguir\u00e0 il pagamento dei Prodotti in base alla procedura prevista e disciplinata da PayPal e ai termini e alle condizioni di contratto convenute tra l\u2019utente e PayPal. I dati inseriti sul sito di PayPal saranno trattati direttamente dalla stessa e non saranno trasmessi o condivisi con Buell Service. Quest\u2019ultima non \u00e8 quindi in grado di conoscere e non memorizza in alcun modo i dati della carta di credito collegata al conto PayPal dell\u2019utente ovvero i dati di qualsiasi altro strumento di pagamento connesso con tale conto.<\/p>\r\n\r\n\r\n\r\n

9.4.2 Nel caso di pagamento mediante PayPal, l\u2019Importo Totale Dovuto sar\u00e0 addebitato da PayPal all\u2019utente contestualmente alla conclusione del contratto tramite il Sito. In caso di risoluzione del contratto di acquisto e in ogni altro caso di rimborso, a qualsiasi titolo, l\u2019importo del rimborso dovuto all\u2019utente sar\u00e0 accreditato sul conto PayPal dello stesso. I tempi di accredito sullo strumento di pagamento collegato a tale conto dipendono esclusivamente da PayPal e dal sistema bancario. Una volta disposto l\u2019ordine di accredito a favore di tale conto, Buell Service non potr\u00e0 essere ritenuta responsabile per eventuali ritardi od omissioni nell\u2019accredito all\u2019utente dell\u2019importo di rimborso, per contestare i quali l\u2019utente dovr\u00e0 rivolgersi direttamente a PayPal.<\/p>\r\n\r\n\r\n\r\n

9.5 Contrassegno<\/p>\r\n\r\n\r\n\r\n

9.5.1 Nel caso di pagamento mediante contrassegno, l\u2019utente deve disporre, al momento della consegna, dell\u2019Importo Totale Dovuto, in contanti. Il corriere non \u00e8 autorizzato ad accettare assegni e non pu\u00f2 dare soldi in resto. Nell\u2019ipotesi i cui, per qualsiasi motivo, il cliente che ha scelto come mezzo di pagamento il contrassegno dovesse avere diritto a un rimborso, Buell Service concorder\u00e0 con l\u2019utente per e-mail le modalit\u00e0 di effettuazione di tale rimborso.<\/p>\r\n\r\n\r\n\r\n

9.5.2 Qualora l\u2019utente abbia scelto il contrassegno, Buell Service gli invier\u00e0 una email, alla quale l\u2019utente dovr\u00e0 rispondere per confermare di voler procedere all\u2019acquisto tramite contrassegno. Per confermare l\u2019ordine, l\u2019utente dovr\u00e0 scrivere: confermo a procedere con l\u2019ordine\u201d. Una volta inviata l\u2019email, l\u2019ordine non potr\u00e0 essere annullato.<\/p>\r\n\r\n\r\n\r\n

10. Diritto di Recesso<\/p>\r\n\r\n\r\n\r\n

10.1 L’utente che rivesta la qualit\u00e0 di consumatore ha diritto di recedere dal contratto concluso con Buell Service , senza dover sostenere costi diversi da quelli indicati nel presenti articolo e senza doverne specificare il motivo, entro quattordici (14) giorni di calendario (Periodo di Recesso). Il Periodo di Recesso scade dopo 14 giorni:<\/p>\r\n\r\n\r\n\r\n

a) nel caso di ordine relativo a un solo Prodotto, dal giorno in cui l\u2019utente o un terzo, diverso dal vettore e designato dall\u2019utente, acquisisce il possesso fisico del Prodotto;<\/p>\r\n\r\n\r\n\r\n

b) nel caso di un Ordine Multiplo con consegne separate, dal giorno in cui l\u2019utente o un terzo, diverso dal vettore e designato dall\u2019utente, acquisisce il possesso fisico dell\u2019ultimo Prodotto; o<\/p>\r\n\r\n\r\n\r\n

c) nel caso di un ordine relativo alla consegna di un Prodotto consistente di lotti o pezzi multipli, dal giorno in cui l\u2019utente o un terzo, diverso dal vettore e designato dall\u2019utente, acquisisce il possesso fisico dell\u2019ultimo lotto o pezzo.<\/p>\r\n\r\n\r\n\r\n

10.2. Per esercitare il diritto di recesso, l\u2019utente deve informare Buell Service\u00a0 della sua decisione di recedere, prima della scadenza del Periodo di Recesso.<\/p>\r\n\r\n\r\n\r\n

10.3 A tal fine l\u2019utente pu\u00f2:<\/p>\r\n\r\n\r\n\r\n

(a) utilizzare il modulo di recesso tipo (Modulo di Recesso Tipo) messo a sua disposizione nel Sito, tramite apposito link, prima della conclusione del contratto, e, in ogni caso, tramite il link \u201cDiritto di Recesso\u201d, presente sul Sito e allegato alla e-mail di conferma della spedizione; oppure<\/p>\r\n\r\n\r\n\r\n

(b) presentare una qualsiasi altra dichiarazione esplicita della sua decisione di recedere dal contratto (Dichiarazione di Recesso).<\/p>\r\n\r\n\r\n\r\n

Il Modulo di Recesso Tipo o la Dichiarazione di Recesso devono essere trasmessi al seguente indirizzo email: ma*********<\/span>@***<\/span>il.com<\/span>.<\/p>\r\n\r\n\r\n\r\n

Poich\u00e9 l\u2019onere della prova relativa all\u2019esercizio del diritto di recesso prima della scadenza del Periodo di Recesso incombe sull\u2019utente, \u00e8 nell\u2019interesse dell\u2019utente avvalersi di un supporto durevole quando comunica a Buell Service il proprio recesso.<\/p>\r\n\r\n\r\n\r\n

10.4 Per la restituzione del Prodotto, l\u2019utente pu\u00f2 servirsi di un vettore a propria scelta con spese di restituzione a carico dell\u2019utente: in tal caso, l\u2019utente, dopo aver esercitato il diritto di recesso con le modalit\u00e0 indicate nel presente articolo, deve provvedere a restituire il Prodotto a Buell Service, utilizzando un vettore a propria scelta e a proprie spese, senza indebito ritardo e in ogni caso entro il termine di 14 giorni di calendario dalla data in cui ha comunicato a Buell Service la sua decisione di recedere. Il termine \u00e8 rispettato, se l\u2019utente rispedisce il Prodotto prima della scadenza del periodo di quattordici giorni. Il Prodotto, opportunamente protetto e imballato, deve essere spedito al seguente indirizzo: Buell Service di Luca Mammarella Via Castorani 65020 Alanno (PE).<\/p>\r\n\r\n\r\n\r\n

I costi diretti della restituzione del Prodotto a Buell Service sono a carico dell\u2019utente. La restituzione del Prodotto a Buell Service avviene sotto la responsabilit\u00e0 dell\u2019utente; il prodotto si intende restituito nel momento in cui esso viene consegnato al vettore.<\/p>\r\n\r\n\r\n\r\n

Qualora l\u2019utente abbia utilizzato un codice sconto per l\u2019acquisto del Prodotto per il quale ha esercitato il diritto di recesso, il rimborso verr\u00e0 effettuato solo con riferimento alla somma di denaro effettivamente spesa dall\u2019utente, e non anche con riguardo al valore del codice sconto.<\/p>\r\n\r\n\r\n\r\n

10.5 Se l\u2019utente recede dal contratto, Buell Service proceder\u00e0 al rimborso dell\u2019Importo Totale Dovuto pagato dall\u2019utente per il Prodotto, compresi i costi di consegna, se applicabili, senza indebito ritardo e in ogni caso non oltre 14 giorni di calendario dal giorno in cui Buell Service \u00e8 stata informata della decisione dell\u2019utente di recedere dal contratto. Il rimborso sar\u00e0 effettuato utilizzando lo stesso mezzo di pagamento usato dall\u2019utente per la transazione iniziale; in ogni caso, l\u2019utente non dovr\u00e0 sostenere alcun costo quale conseguenza di tale rimborso.<\/p>\r\n\r\n\r\n\r\n

10.6 Nel caso di recesso parziale, l\u2019importo delle spese di consegna da restituire all\u2019utente a seguito del recesso sar\u00e0 calcolato come indicato nell\u2019art. 8.3 che precede.<\/p>\r\n\r\n\r\n\r\n

10.7 L\u2019utente \u00e8 responsabile unicamente della diminuzione del valore dei beni risultante da una manipolazione del Prodotto diversa da quella necessaria per stabilire la natura, le caratteristiche e il funzionamento del Prodotto. Il Prodotto dovr\u00e0 comunque essere custodito, manipolato e ispezionato con la normale diligenza e restituito integro, completo in ogni sua parte, perfettamente funzionante, corredato da tutti gli accessori e i fogli illustrativi, con i cartellini identificativi, le etichette e il sigillo monouso, ove presenti, ancora attaccati al Prodotto e integri e non manomessi, nonch\u00e9 perfettamente idoneo all\u2019uso cui \u00e8 destinato e privo di segni di usura o sporcizia. Il recesso, inoltre, trova applicazione al Prodotto nella sua interezza. Esso non pu\u00f2 pertanto essere esercitato in relazione a parti e\/o accessori (che non costituiscano Prodotti autonomi) del Prodotto.<\/p>\r\n\r\n\r\n\r\n

10.8 Nel caso in cui il recesso non sia stato esercitato conformemente a quanto previsto dalla normativa applicabile, esso non comporter\u00e0 la risoluzione del contratto e, conseguentemente, non dar\u00e0 diritto ad alcun rimborso. Buell\u00a0 Service ne dar\u00e0 comunicazione all’utente entro 5 giorni lavorativi dal ricevimento del Prodotto, respingendo la richiesta di recesso. Il Prodotto, qualora gi\u00e0 pervenuto a Buell Service, rimarr\u00e0 presso Buell Service a disposizione dell\u2019utente per il ritiro che dovr\u00e0 avvenire a spese e sotto la responsabilit\u00e0 dell\u2019utente medesimo.<\/p>\r\n\r\n\r\n\r\n

10.9 Nel caso in cui il Prodotto per il quale \u00e8 stato esercitato il recesso abbia subito una diminuzione di valore risultante da una manipolazione del bene diversa da quella necessaria per stabilire la natura, le caratteristiche e il funzionamento del Prodotto, l\u2019importo di rimborso sar\u00e0 decurtato di un importo pari a tale diminuzione di valore. Della circostanza e del conseguente diminuito importo di rimborso Buell Service dar\u00e0 comunicazione all\u2019utente entro 5 giorni lavorativi dal ricevimento del Prodotto, fornendo allo stesso, nel caso in cui il rimborso sia gi\u00e0 stato corrisposto, le coordinate bancarie per il pagamento dell\u2019importo dovuto dall\u2019utente a causa della diminuzione di valore del Prodotto.<\/p>\r\n\r\n\r\n\r\n

10.10 Nel caso in cui, ricorrendo una delle ipotesi di legge, il diritto di recesso non trovi applicazione, di tale esclusione sar\u00e0 data specifica ed espressa comunicazione nella Scheda Prodotto e, in ogni caso, durante il procedimento di acquisto, prima che l\u2019utente proceda alla trasmissione dell\u2019ordine. Si ricorda in ogni caso all\u2019utente che, ai sensi dell’art. 59 del Codice del Consumo, il diritto di recesso \u00e8 escluso, tra l\u2019altro, nel caso in cui la vendita abbia ad oggetto:<\/p>\r\n\r\n\r\n\r\n

(i) prodotti confezionati su misura o chiaramente personalizzati;<\/p>\r\n\r\n\r\n\r\n

(ii) di prodotti sigillati che non si prestano a essere restituiti per motivi igienici o connessi alla protezione della salute, che siano stati aperti dopo la consegna.<\/p>\r\n\r\n\r\n\r\n

10.11 Indipendentemente dalla possibilit\u00e0 di esercitare il diritto di recesso, Buell Service offre all\u2019utente la possibilit\u00e0 di esercitare il diritto di reso, secondo i termini e le condizioni indicate alla pagina \u201cResi\u201d presente sul Sito. Il diritto di reso si aggiunge e non sostituisce il diritto di recesso disciplinato dagli articoli che precedono.<\/p>\r\n\r\n\r\n\r\n

11. Codici sconto<\/p>\r\n\r\n\r\n\r\n

11.1 Sul Sito \u00e8 possibile acquistare anche tramite codici sconto rilasciati da Buell Service. Se il valore del codice sconto \u00e8 inferiore a quello dell’ordine, la somma rimanente pu\u00f2 essere completata secondo i metodi di pagamento previsti sul Sito.<\/p>\r\n\r\n\r\n\r\n

11.2 I codici sconto non sono cumulabili tra loro a fronte di un unico acquisto. I codici sconto possono essere utilizzati anche per l’acquisto di prodotti gi\u00e0 in promozione. Non \u00e8 possibile utilizzare codici sconto per pagamenti di importi di spesa inferiori al loro valore. Ciascun codice sconto pu\u00f2 essere utilizzato per un solo acquisto. In nessun caso i codici sconto danno diritto a resto nel caso di acquisti di importo inferiore.<\/p>\r\n\r\n\r\n\r\n

11.3 Eventuali prodotti per i quali non sar\u00e0 possibile utilizzare i codici sconto saranno debitamente segnalati sul Sito. Nel caso di annullamento per qualsiasi causa di un ordine per il quale \u00e8 stato utilizzato un codice sconto, il relativo importo sar\u00e0 riaccreditato sull\u2019account personale del cliente.<\/p>\r\n\r\n\r\n\r\n

11.4 In nessun caso i buoni sconto possono essere convertiti in denaro.<\/p>\r\n\r\n\r\n\r\n

12. Garanzia Legale di Conformit\u00e0<\/p>\r\n\r\n\r\n\r\n

Tutti i Prodotti venduti sul Sito sono coperti dalla Garanzia Legale di Conformit\u00e0 prevista dagli artt. 128-135 del Decreto Legislativo n. 128-135 del Codice del Consumo (Garanzia Legale).<\/p>\r\n\r\n\r\n\r\n

A CHI SI APPLICA<\/p>\r\n\r\n\r\n\r\n

La Garanzia Legale \u00e8 riservata ai consumatori. Essa, pertanto, trova applicazione, solo agli utenti che hanno effettuato l’acquisto sul Sito per scopi estranei all’attivit\u00e0 imprenditoriale, commerciale, artigianale o professionale eventualmente svolta. A coloro che hanno acquistato sul Sito e che non rivestano la qualit\u00e0 di consumatori saranno applicate la garanzie per i vizi della cosa venduta, la garanzia per difetto di qualit\u00e0 promesse ed essenziali e le altre garanzie previste dal codice civile con i relativi termini, decadenze e limitazioni.<\/p>\r\n\r\n\r\n\r\n

QUANDO SI APPLICA<\/p>\r\n\r\n\r\n\r\n

Il venditore \u00e8 responsabile nei confronti del consumatore per qualsiasi difetto di conformit\u00e0 esistente al momento della consegna del Prodotto e che si manifesti entro due anni da tale consegna. Il difetto di conformit\u00e0 deve essere denunciato al venditore, a pena di decadenza dalla garanzia, nel termine di due mesi dalla data in cui \u00e8 stato scoperto.<\/p>\r\n\r\n\r\n\r\n

Salvo prova contraria, si presume che i difetti di conformit\u00e0 che si manifestano entro i sei mesi dalla consegna del Prodotto esistessero gi\u00e0 a tale data, a meno che tale ipotesi sia incompatibile con la natura del Prodotto o con la natura del difetto di conformit\u00e0. A partire dal settimo mese successivo alla consegna del Prodotto, sar\u00e0 invece onere del consumatore provare che il difetto di conformit\u00e0 esisteva gi\u00e0 al momento della consegna dello stesso.\u00a0<\/p>\r\n\r\n\r\n\r\n

Per poter usufruire della Garanzia Legale, l’utente dovr\u00e0 quindi fornire innanzitutto prova della data dell’acquisto e della consegna del bene. E’ opportuno, quindi, che l’utente, a fini di tale prova, conservi la fattura di acquisto, che Buell Service gli invia, ovvero qualsiasi altro documento che possa attestare la data di effettuazione dell’acquisto (per esempio l’estratto conto della carta di credito) e la data della consegna.<\/p>\r\n\r\n\r\n\r\n

CHE COS\u2019E’ IL DIFETTO DI CONFORMITA\u2019<\/p>\r\n\r\n\r\n\r\n

Si ha un difetto di conformit\u00e0, quando il bene acquistato:<\/p>\r\n\r\n\r\n\r\n

– non \u00e8 idoneo all’uso al quale servono abitualmente beni dello stesso tipo;<\/p>\r\n\r\n\r\n\r\n

– non \u00e8 conforme alla descrizione fatta dal venditore e non possiede le qualit\u00e0 del bene che il venditore ha presentato al consumatore come campione o modello;<\/p>\r\n\r\n\r\n\r\n

– non presenta\u00a0 le qualit\u00e0 e prestazioni abituali di un bene dello stesso tipo, che il consumatore pu\u00f2 ragionevolmente aspettarsi, tenuto conto anche delle dichiarazioni fatte nella pubblicit\u00e0 o nella etichettatura;<\/p>\r\n\r\n\r\n\r\n

– non \u00e8 idoneo all’uso particolare voluto dal consumatore e che sia stato da questi portato a conoscenza del venditore al momento della conclusione del contratto e che il venditore abbia accettato.<\/p>\r\n\r\n\r\n\r\n

Sono quindi esclusi dal campo di applicazione della Garanzia Legale eventuali guasti o malfunzionamenti o difetti di altro tipo determinati da fatti accidentali o da responsabilit\u00e0 dell’utente ovvero da un uso del Prodotto non conforme alla sua destinazione d’uso e\/o a quanto previsto nella documentazione tecnica allegata al Prodotto, ove esistente, o nelle istruzioni di uso relative al medesimo.<\/p>\r\n\r\n\r\n\r\n

RIMEDI A DISPOSIZIONE DELL’UTENTE<\/p>\r\n\r\n\r\n\r\n

In caso di difetto di conformit\u00e0 debitamente denunciato nei termini, l’utente ha diritto:<\/p>\r\n\r\n\r\n\r\n

– in via primaria, alla riparazione o sostituzione gratuita del bene, a sua scelta, salvo che il rimedio richiesto sia oggettivamente impossibile o eccessivamente oneroso rispetto all’altro e, quindi, nel caso specifico, considerata la tipologia di vendita, alla sostituzione, ove ci\u00f2 sia possibile in relazione al numero di esemplari ancora disponibili per la vendita;<\/p>\r\n\r\n\r\n\r\n

– in via secondaria (nel caso cio\u00e8 in cui la riparazione o la sostituzione siano impossibili o eccessivamente onerose ovvero la riparazione o la sostituzione non siano state realizzate entro termini congrui ovvero la riparazione o la sostituzione precedentemente effettuate abbiano arrecato notevoli inconvenienti al consumatore) alla riduzione del prezzo o alla risoluzione del contratto, a sua scelta.<\/p>\r\n\r\n\r\n\r\n

Il rimedio richiesto \u00e8 eccessivamente oneroso se impone al venditore spese irragionevoli in confronto ai rimedi alternativi che possono essere esperiti, tenendo conto (i) del valore che il bene avrebbe se non vi fosse il difetto di conformit\u00e0; (ii) dell’entit\u00e0 del difetto di conformit\u00e0; (iii) dell’eventualit\u00e0 che il rimedio alternativo possa essere esperito senza notevoli inconvenienti per il consumatore.<\/p>\r\n\r\n\r\n\r\n

COSA FARE IN PRESENZA DI UN DIFETTO DI CONFORMITA’<\/p>\r\n\r\n\r\n\r\n

Nel caso in cui un Prodotto acquistato sul Sito, nel corso del periodo di validit\u00e0 della Garanzia Legale, manifesti quello che potrebbe essere un difetto di conformit\u00e0, l’utente deve contattare il Servizio Clienti, ai recapiti e con le modalit\u00e0 indicate all\u2019art. 14. Buell Service dar\u00e0 tempestivo riscontro alla comunicazione del presunto difetto di conformit\u00e0 e indicher\u00e0 all\u2019utente la specifica procedura da seguire, anche per concordare le modalit\u00e0 di spedizione della merce, tenendo conto anche della categoria merceologica cui il Prodotto appartiene e\/o del difetto denunciato.<\/p>\r\n\r\n\r\n\r\n

RIMBORSO O RIDUZIONE IN CONSEGUENZA DELLA APPLICAZIONE DELLA GARANZIA LEGALE<\/p>\r\n\r\n\r\n\r\n

In caso di risoluzione del contratto, Buell Service restituir\u00e0 all’utente l’importo complessivo pagato, costituito dal prezzo di acquisto del Prodotto, dalle spese di spedizione e da ogni altro eventuale costo aggiuntivo. In caso di riduzione del prezzo, Buell Service restituir\u00e0 l’importo della riduzione, previamente concordato con l’utente. In alternativa, l’utente potr\u00e0 scegliere di ricevere un buono acquisto, spendibile sul Sito, di valore equivalente all’importo del rimborso o, rispettivamente, della riduzione a cui ha diritto.<\/p>\r\n\r\n\r\n\r\n

L’importo del rimborso o della riduzione verr\u00e0 comunicato all’utente via e-mail e accreditato sul mezzo o la soluzione di pagamento utilizzato\/a dall’utente per l’acquisto.<\/p>\r\n\r\n\r\n\r\n

Buell Service non \u00e8 responsabile in caso di danni, di qualsivoglia natura, derivanti dall’uso del Prodotto in modo improprio e\/o non conforme alle istruzioni fornite dal produttore nonch\u00e9 in caso di danni derivanti da caso fortuito o forza maggiore.<\/p>\r\n\r\n\r\n\r\n

13. Legge applicabile e foro competente; composizione stragiudiziale delle controversie – Alternative Dispute Resolution\/Online Dispute Resolution<\/p>\r\n\r\n\r\n\r\n

13.1 I contratti conclusi tra gli utenti del Sito e Buell Service sono regolati dalla legge italiana. E\u2019 fatta salva la applicazione agli utenti consumatori che non abbiano la loro residenza abituale in Italia delle disposizioni eventualmente pi\u00f9 favorevoli e inderogabili previste dalla legge del paese in cui essi hanno la loro residenza abituale, in particolare in relazione al termine per l\u2019esercizio del diritto di recesso, al termine per la restituzione dei Prodotti, in caso di esercizio di tale diritto, alle modalit\u00e0 e formalit\u00e0 della comunicazione del medesimo e alla garanzia legale di conformit\u00e0.<\/p>\r\n\r\n\r\n\r\n

13.2 Si ricorda che nel caso di utente consumatore, per ogni controversia relativa all\u2019applicazione, esecuzione e interpretazione delle presenti Condizioni Generali di Vendita \u00e8 competente il foro del luogo in cui l\u2019utente risiede o ha eletto domicilio.<\/p>\r\n\r\n\r\n\r\n

13.3 Ai sensi dell’art. 141-sexies, comma 3 del Decreto Legislativo 6 settembre 2005, n.206 (Codice del Consumo), Buell Service informa l’utente che rivesta la qualifica di consumatore di cui all’art. 3, comma 1, lett. a) del Codice del Consumo, che, nel caso in cui egli abbia presentato un reclamo direttamente a Buell Service, a seguito del quale non sia stato tuttavia possibile risolvere la controversia cos\u00ec insorta, Buell Service fornir\u00e0 le informazioni in merito all’organismo o agli organismi di Alternative Dispute Resolution per la risoluzione extragiudiziale delle controversie relative ad obbligazioni derivanti da un contratto concluso in base alle presenti Condizioni Generali di Vendita (cc.d.. organismi ADR, come indicati agli artt. 141-bis e ss. Codice del Consumo), precisando se intenda avvalersi o meno di tali organismi per risolvere la controversia stessa.<\/p>\r\n\r\n\r\n\r\n

Buell Service informa inoltre l’utente che rivesta la qualifica di consumatore di cui all’art. 3, comma 1, lett a) del Codice del Consumo che \u00e8 stata istituita una piattaforma europea per la risoluzione on-line delle controversie dei consumatori (c.d. piattaforma ODR). 3. Registration on the Site<\/span><\/p>\r\n

4. Direct information for the conclusion of the contract<\/span><\/p>\r\n

4.1 In compliance with Legislative Decree 9 April 2003, n. 70 laying down provisions on electronic commerce, Buell Service informs the user that: – to conclude the purchase contract for one or more Products on the Site, the user must complete an electronic order form and send it to Buell Service , electronically, following the instructions that appear from time to time on the Site and that will accompany the different stages of the purchase; – the contract is concluded when the order form reaches the Buell Service server; – once the form is registered of order and upon receiving the confirmation of the authorization to pay the total amount due, Buell Service will send the confirmation of the order to the user by e-mail to the address indicated, containing information on the characteristics of the Product purchased, the detailed indication of the price, the means of payment used, information on the right of withdrawal, delivery costs and any additional costs as well as Contact Customer Service, where the user can contact for assistance and \/ or file complaints. It is recommended to keep the e-mail received as proof of purchase. 5. Validity of offers and prices<\/span><\/p>\r\n

5.1 All Product prices are expressed in Euro (\u20ac) and are included in the Value Added Tax (“VAT”). Any additional costs, including VAT, will be expressly and separately indicated on the order form, before the user proceeds with the transmission of the same.<\/span><\/p>\r\n

5.2 The price of the Products can be modified by Buell Service at any time, without notice, without prejudice to that the price charged to the user will be the one published on the information sheet illustrating the main characteristics of the Product (Product Sheet) at the time the order is sent. Any changes (up or down) in price after the transmission of the order will not be taken into account.<\/span><\/p>\r\n

5.3 On the Site, Products at discounted prices may be offered for sale. The full price indicated on the Site (Barrato Price) and with respect to which the discount that the Buell Service applies applies to the list price published on the Site.<\/span><\/p>\r\n

6. Purchase Orders – Product Information<\/span><\/p>\r\n

6.1 Buell Service will proceed with the purchase order, and will therefore ship the purchased Product, only after receiving confirmation of the authorization to pay the total amount due, consisting of the price d ‘purchase, from delivery costs, if applied, and from any other possible additional cost, as indicated in the order form (Total Amount Due). In the event that the Total Amount Due is not paid or the successful outcome of the payment is not confirmed, the purchase contract will therefore be considered terminated by law pursuant to and for the purposes of art. 1456 of the Italian Civil Code Of this resolution and the consequent cancellation of the order, the user will be notified immediately after the transmission of the order, via the Site.<\/span><\/p>\r\n

6.2 The Products will remain the property of Buell Service until the payment has been made by the user of the Total Amount Due. The risk of loss or damage to the Products, for reasons not attributable to Buell Service, however, will be transferred to the user when the user, or a third party designated by him and different from the carrier, will physically take possession of the Products.<\/span><\/p>\r\n

6.3 Each Product is accompanied by a Product Card. The images and descriptions on the Site reproduce the characteristics of the Products as faithfully as possible. The colors of the Products, however, may differ from the real ones due to the settings of the computer systems or the computers used by the users for their display. Furthermore, the images of the Product on the Product Sheet may differ in size or in relation to any accessory products. These images must therefore be understood as indicative and with tolerances of use. For the purposes of the purchase contract, the description of the Product contained in the order form sent by the user will prevail.<\/span><\/p>\r\n

7. Product Availability<\/span><\/p>\r\n

7.1 The products offered on the Site are limited in number. It may therefore happen, also due to the possibility that several users buy the same Product at the same time, that the ordered Product is no longer available after the transmission of the purchase order.<\/span><\/p>\r\n

7.2 In any case of unavailability of the ordered Product, subject to the rights attributed to the user by law, and, in particular, from Chapter XIV of Title II of Book IV of the Civil Code, the user will be promptly informed by e-mail. The user will therefore be entitled to immediately terminate the contract, subject to the right to compensation for damages, pursuant to and for the purposes of the provisions of art. 61, IV and V paragraph, of the Consumer Code. In the case in which the user makes use of the right of resolutionexart. 61, IV and V paragraph, Consumer Code or in any case where the payment of the Total Amount Due has already occurred, Buell Service, without prejudice to the user’s right to compensation for damages, will reimburse this amount without undue payment delay and, in any case, within the maximum term of 15 working days from the sending of the order. Any delay in crediting may depend on the bank, the type of credit card or the payment solution used. In any case, the value date will be the same as the debit date.<\/span><\/p>\r\n

7.3 In the case of orders concerning a plurality of Products (Multiple Orders), if the supervening unavailability concerns only some of the Products covered by the Multiple Order – without prejudice to the rights attributed to the user by the law, and, in particular, by the Chief XIV of Title II of Book IV of the Civil Code, and without prejudice to the application of the art. 7.2 above, if the supervening unavailability concerns all the Products subject to the order – Buell Service will immediately notify the user by e-mail. The user will therefore be entitled to immediately terminate the contract, limited to the Product (s) which has become unavailable, subject to the right to compensation for damages, pursuant to and for the purposes of the provisions of art. 61, IV and V paragraph, of the Consumer Code. In the event that the user makes use of the right of resolution pursuant to art. 61, IV and V paragraph, Consumer Code, in relation to the Product (s) which has become unavailable or in any case in which the payment of the Total Amount Due has already taken place, Buell Service, without prejudice to the right the user to pay damages, will refund the amount due in relation to this Product (s), including delivery costs, calculated as indicated in the art. 8.3 below, and any other possible additional costs due in specific relation to these Products (Partial Amount Due) without undue delay and, in any case, within the maximum term of 15 working days from the dispatch of the order. The refund amount will be communicated to the user via e-mail. This amount will be credited to the same payment method used by the user for the purchase. Any delay in crediting may depend on the bank, the type of credit card or the payment solution used. In any case, the value date will be the same as the debit date. The resolution of the entire Multiple Order will be possible only in the case of evident and proven accessories of the Products covered by the Multiple Order which have become unavailable with respect to the other Products object of the Multiple Order available.<\/span><\/p>\r\n

8. Delivery of purchased Products8.1 If due, the amount of delivery costs due by the user in relation to a specific order, is expressly and separately indicated (in Euro and inclusive of VAT) during the purchase process, in the summary of the order and, in any case, before the user proceeds with the transmission of the same. In the case of shipments to areas outside the EU,<\/strong><\/span>greater than 2 kg and with a volume equal to or greater than 1.5 cubic meters,<\/span><\/strong>a surcharge will be applied to the cost of shipping already indicated in the purchase summary. It will be our pleasure to contact the buyer to communicate this amount.<\/strong><\/span><\/p>\r\n

8.2 In the event of failure to indicate a specific delivery term, it will take place, in any case, within thirty days from the date of conclusion of the contract.<\/span><\/p>\r\n

8.3 In the case of partial withdrawal from Multiple Orders, the amount of delivery costs to be reimbursed to the user will be quantified in proportion to the value of the Product subject to withdrawal.<\/span><\/p>\r\n

8.4 The delivery obligation is fulfilled by transferring the material availability or in any case the control of the Products to the ‘user.<\/span><\/p>\r\n

It is up to the user to check the conditions of the Product that was delivered to him \/ her that he \/ she has collected. It being understood that the risk of loss or damage of the Products, for reasons not attributable to Buell Service, is transferred to the user when the user, or a third party designated by him and different from the carrier, enters into physical possession of the Product, it is recommended to user to verify the number of Products received and that the packaging is intact, not damaged, wet or otherwise altered, even in the closing materials and is invited, in its interest, to indicate on the carrier’s transport document, if any anomalies, accepting the parcel with reserve. The receipt without reservation of the Products, in fact, does not allow the user to take legal action against the courier, in the event of loss or damage to the Products, except in the event that the loss or damage is due to fraud or gross negligence of the same courier and except for partial loss or damage not recognizable at the time of delivery, as long as in the latter case, the damage is reported as soon as known and no later than eight days after receipt. In the event that the packaging shows obvious signs of tampering or alteration, it is also recommended that the user promptly notify Customer Service. In any case, the application of the rules concerning the right of withdrawal and the legal guarantee of conformity remains valid. The courier makes two delivery attempts, after which it will return the Products to Buell Service, which will reimburse the customer for the money. At the time of delivery, nothing is due to the courier.<\/span><\/p>\r\n

8.5 The provisions of art. 61 of the Consumer Code in the event that the purchased Product is not delivered or is delivered late with respect to the delivery terms indicated during the purchase process and in the order confirmation. In any case, Buell Service undertakes to give notice to the ‘user, promptly and by e-mail, of the delay in delivery (Delay Notice E-mail), indicating the new delivery time, if available (New Delivery Time), subject to the user’s rights pursuant to art. 61 of the Consumer Code and the possibility of availing at any time of the ordinary means of protection made available by the law and, in particular, by Chapter XIV of Title II of Book IV of the civil code.<\/span><\/p>\r\n

9. Method of Payment<\/span><\/p>\r\n

9.1 The payment of the Products can be made by credit card or through the PayPal payment solution. In the event that one of these payment methods \/ solutions cannot be used in relation to a specific Product, this will be clearly indicated on the Website, at the latest at the beginning of the purchase procedure. information provided for this purpose by the user, which he declares and guarantees to be true, obliging himself to keep Buell Service undamaged and harmless from any damage, including sanctions issued by the competent authorities, which may derive from the same in the event of non-compliance of the true themselves. In case of need for invoicing, please specify it in the “order notes” section, at the bottom of the data entry.<\/span><\/p>\r\n

9.3 Payment by credit or debit card<\/span><\/p>\r\n

9.3.1 Payment for the Products can be made by card of credit or debit directly through the Site.<\/span><\/p>\r\n

9.3.2 In order to guarantee the security of payments made on the Site and prevent any fraud, Buell Service reserves the right to ask the user, via e-mail, to send, via the same means, a front \/ back copy of your identity card and, in the event that the holder of the order is different from the holder of the card, the identity card of the latter. The document must be valid. The deadline within which the document must reach Buell Service will be specified in the request e-mail. This term will not, in any case, exceed 5 working days starting from the receipt of the request by the user. Pending the requested document, the order will be suspended. 9.3.3 In the event that Buell Service does not receive these documents within the period specified in the request e-mail or receives expired or invalid documents, the contract will be considered terminated by law pursuant to and for the purposes of Article 1456 of the Civil Code and the order consequently canceled, without prejudice to Buell Service’s right to compensation for any damage in which it may be incurred due to the user’s improper behavior. The termination of the contract, of which the user will be notified by e-mail, no later than 5 working days from the deadline for sending the documents required by Buell Service, will result in the cancellation of the order, with consequent repayment of the Total Amount Due.<\/span><\/p>\r\n

9.3.4 In the case of receipt by Buell Service of documentation valid within the term indicated in the e-mail referred to in art. 9.3.2 above, the delivery terms will run from the date of receipt of the same.<\/span><\/p>\r\n

9.3.5 Confidential credit card data (card number, holder, expiration date, security code) are encrypted and transmitted directly to the manager payments without passing through the servers that Buell Service uses. Buell Service therefore has no access and does not store the data of the credit card used by the user for the payment of the Products, except, limited to the data relating to the holder of the card, the case provided for in Articles. 9.3.2 and 9.3.3.<\/span><\/p>\r\n

9.4 Payment by PayPal payment solution <\/span><\/p>\r\n

9.4.1 Payment for Products purchased on the Site can be made using the PayPal payment solution. If the user chooses PayPal as the payment method, he will be redirected to the www.paypal.it site where he will pay the Products according to the procedure provided for and governed by PayPal and the terms and conditions of the contract agreed between the user and PayPal. The data entered on the PayPal site will be processed directly by the same and will not be transmitted or shared with Buell Service. The latter is therefore unable to know and does not memorize in any way the data of the credit card connected to the user’s PayPal account or the data of any other payment instrument connected with this account.<\/span><\/p>\r\n

9.4.2 In the case of payment through PayPal, the Total Amount Due will be charged by PayPal to the user at the same time as the conclusion of the contract through the Site. In the event of termination of the purchase contract and in any other case of reimbursement, for any reason, the refund amount due the user will be credited to his PayPal account. The credit times on the payment instrument connected to this account depend exclusively on PayPal and the banking system. Once the credit order has been placed in favor of this account, Buell Service cannot be held responsible for any delays or omissions in crediting the user to the refund amount, to dispute which the user will have to contact PayPal directly.

9.5 Cash on delivery<\/span><\/p>\r\n

9.5.1 In the case of payment by cash on delivery, the user must have, at the time of delivery, the Total Amount Due, in cash. The courier is not authorized to accept checks and cannot give money in rest. In the event that, for any reason, the customer who has chosen the cash on delivery as a means of payment should be entitled to a refund, Buell Service will agree with the user by e-mail on how to make such reimbursement.<\/span><\/p>\r\n

9.5.2 If the user has chosen the mark, Buell Service will send him an email, to which the user will have to reply to confirm that he wishes to proceed with the purchase by cash on delivery. To confirm the order, the user must write: I confirm to proceed with the order “. Once the email has been sent, the order cannot be canceled.<\/span><\/p>\r\n

10. Right of Withdrawal<\/span><\/p>\r\n

10.1 The consumer who has the quality of consumer has the right to withdraw from the contract concluded with Buell Service, without having to incur costs other than those indicated in the present article and without having to specify the reason, within fourteen (14) days of calendar (Withdrawal Period). The Withdrawal Period expires after 14 days: a) in the case of an order relating to only one Product, from the day on which the user or a third party other than the carrier and designated by the user acquires physical possession of the Product, b) in the case of a Multiple Order with separate deliveries, from the day on which the user or a third party other than the carrier and designated by the user acquires physical possession of the last Product; or c) in the case of an order relating to the delivery of a Product consisting of multiple lots or pieces, from the day on which the user or a third party other than the carrier and designated by the user acquires physical possession of the last lot. <\/span><\/p>\r\n

10.2. To exercise the right of withdrawal, the user must inform Buell Service of his decision to withdraw, before the expiration of the Withdrawal Period.<\/span><\/p>\r\n

10.3 For this purpose the user can: (a) use the standard withdrawal form (Withdrawal Form Type) made available to it on the Site, through a special link, before the conclusion of the contract, and, in any case, through the link “Right of Withdrawal”, present on the Site and attached to the e-mail confirming the shipment; or (b) submit any other explicit statement of its decision to withdraw from the contract (Declaration of Withdrawal). 10.5 If the user withdraws from the contract, Buell Service will reimburse the Total Amount Due paid by the user for the Product, including delivery costs, if applicable, without undue delay and in any case no later than 14 calendar days from day on which Buell Service was informed of the user’s decision to withdraw from the contract. The refund will be made using the same payment method used by the user for the initial transaction; in any case, the user will not incur any costs as a result of such reimbursement.<\/span><\/p>\r\n

10.6 In the case of partial withdrawal, the amount of delivery costs to be returned to the user following the withdrawal will be calculated as indicated in the art. 8.3 above.<\/span><\/p>\r\n

10.7 The user is solely responsible for the decrease in the value of the goods resulting from the handling of the Product other than that necessary to establish the nature, characteristics and functioning of the Product. The Product must in any case be kept, handled and inspected with normal diligence and returned intact, complete in all its parts, fully functional, accompanied by all accessories and illustrative sheets, with identification tags, labels and the disposable seal, where present , still attached to the Product and intact and not tampered with, as well as perfectly suited to the use for which it is intended and free from signs of wear or dirt. The withdrawal also applies to the Product in its entirety. It cannot therefore be exercised in relation to parts and \/ or accessories (which do not constitute autonomous Products) of the Product.<\/span><\/p>\r\n

10.8 In the event that the withdrawal has not been exercised in accordance with the provisions of the applicable legislation, it will not entail the termination of the contract and consequently will not be entitled to any refund. 10.9 In the event that the Product for which the withdrawal was exercised has suffered a decrease in value resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the Product, the refund amount will be reduced by an amount equal to this decrease in value. Buell Service will notify the user within 5 working days of receipt of the Product of the circumstance and of the consequent decreased reimbursement amount, providing the same, in the event that the refund has already been paid, the bank details for the payment of the amount due by the user due to the decrease in value of the Product.<\/span><\/p>\r\n

10.10 In the event that, by recourse to a legal hypothesis, the right of withdrawal does not apply, this exclusion will be given specific and express communication in the Product Sheet and, in any case , during the purchase process, before the user proceeds with the transmission of the order.
